Next tranche of workplace relations law changes

The ACCI workplace relations team continues to consult with members and industry on the government’s next tranche of IR changes, including “employee-like” changes which will impact independent contracting arrangements, “same job, same pay” changes which will impact labour hire arrangements, casual changes and the introduction of wage theft laws.

Member feedback is being passed directly to the workplace relations minister’s office and department on an ongoing basis to assist in informing the final legislation being developed.

ACCI chief executive Andrew McKellar and director of workplace relations Jessica Tinsley will meet today with the Minister for Employment and Workplace Relations, Tony Burke, and ACCI gig platform members to discuss the potential impacts of the proposed ‘employee-like’ legislation on Australia’s business community.

The omnibus bill is expected to be introduced to parliament sometime over the next month or two.

Intervention in Virgin’s intractable bargaining declaration application – Fair Work Commission

ACCI has been granted leave to intervene in the matter of Virgin Australia Regional Airlines Pty Ltd’s application for an intractable bargaining declaration (B2023/543).

This is an important test case, which will have ramifications for all employers susceptible to protracted industrial action arising because of drawn out enterprising bargaining disputes.

ACCI’s submissions, due today, will support the Fair Work Commission having greater scope to intervene to assist bargaining and agreement making than has previously been the case.

In doing so, ACCI’s submissions address:

  • the considerations relevant to determining whether there are “no reasonable prospect of agreement being reached” during bargaining, and
  • the considerations relevant to determining whether it is “reasonable in all of the circumstances” to make an intractable bargaining declaration.
